As the Activate NIL team has been enjoying the first couple weeks of summer, NIL has changed before our very eyes!
The Florida High School Athletic Association (FHSAA) announced last week that they will allow NIL at the high school level. The rules (linked here) still need to pass the State Board of Education's vote in late July and are not technically in effect yet.
Florida's high school NIL policies follow a similar structure as other states and include:
- No deals surrounding drugs, alcohol, adult content, prescribed pharmaceuticals, weapons of any kind, NIL collectives, political or social activism, etc.
- NIL is not able to be used for recruiting
- No using school marks, facilities, equipment, and more in NIL activities
Even though the policy has technically not gone into effect yet, high school athletes in Florida are already capitalizing on NIL opportunities. Top 2025 Recruits Jaime French and Vernell "Trey" Brown were some of the first high school athletes in Florida to sign NIL deals. Both football players signed with American Eagle, while Vernell also signed with Adidas.
Are these deals allowed? It's unclear because of the FHSAA wording. Technically, the Florida Board of Education hasn't approved the new policy, but does that mean these NIL deals aren't allowed? That's for the FHSAA to decide.
Who's next? South Dakota is potentially the 37th state to allow NIL in high school. The state is holding serious conversations about NIL at the high school level. With this trend, it's expected that other states could follow suit. Could Texas be the 38th state?
